GoodHub Platforms Limited/GoodHub “Personal Crowdfunder” Terms and Conditions

GoodHub.com is a trading name of GoodHub Platforms Limited (company number 10702553), registered in England, and has its registered office at 7 Gay Street, Bath, Somerset, BA1 2PH, England. We are registered with the office of the information commissioner (no. ZA290916) for data protection purposes.

Please note that we do not offer regulated investments through the platform. Therefore we are not authorised or regulated by the Financial Conduct Authority.

Where the term “GoodHub” is used in these Terms and Conditions, that term applies to GoodHub.com and GoodHub Platforms Limited.

Where the term “Organisation” is used in these Terms and Conditions, that term will apply to any entity registering on GoodHub.

Where the term “Personal Crowdfunder” is used in these Terms and Conditions, that term will apply to any individual registering on GoodHub with the intention to create a Personal Crowdfunding page.

Where the term “Fundraiser” is used in these Terms and Conditions, that term will apply to any individual creating a fundraising page on behalf of a Personal Crowdfunder. This applies whether that individual is raising funds on behalf of the Personal Crowdfunder, or whether they are creating a fundraising page on behalf of another individual, individuals, or a team in order that they can raise funds for the Personal Crowdfunder.

Where the term “User” is used in these Terms and Conditions, that term will apply to a donor, ticket purchaser or entrant to a sponsored event. The terms “user”, “donor”, “purchaser”, entrant and similar terms are interchangeable.

These Terms and Conditions may change or be updated from time to time. It remains your responsibility to access and check these Terms and Conditions wherever you access the website. The latest version of these Terms and Conditions will govern any future usage by you of the website and its associated services. The date on which these Terms of Service were last updated is stated at the end of this document.

WHAT WE DO

GoodHub.com provides an “online meeting place” and platform for UK registered Organisations and Personal Crowdfunders to communicate with their community and the public, and to promote and increase awareness of their Personal Crowdfunding page.

The services provided by GoodHub include verification and due diligence in relation to Personal Crowdfunders, including identity, contact and bank account verification and such fraud, security and financial crime checks as GoodHub considers appropriate, the provision of advice and support on communication and fundraising strategies for Personal Crowdfunders, distributing and promoting a Personal Crowdfunder’s page hosted on GoodHub.com. We also manage the collection and the distribution of funds to beneficiary Personal Crowdfunders with reconciling data.

WHAT WE DON’T DO

Although we may promote, advertise or raise awareness of certain Personal Crowdfunders, campaigns, events or fundraisers, we will not be involved in the management of or use of donations, participation (entrance) fees or ticket sale proceeds. If a Personal Crowdfunder offers an incentive or reward in relation to any fundraising campaign or event, GoodHub will not directly offer or fulfil these.

Other than as mentioned above, we do not have any involvement in any arrangements Personal Crowdfunders, users and fundraisers make with each other through GoodHub. The arrangements made between Personal Crowdfunders, fundraisers and users are solely private and are made directly between the individual parties concerned. Accordingly, when using GoodHub, Personal Crowdfunders take full responsibility for their arrangements with fundraisers and donors whom they contact and the nature, terms and extent of their arrangements with them and obligations to them.

We do not verify the identity of anyone who becomes a user or fundraiser. We cannot therefore give any guarantee that any users or fundraisers are who they say they are or that the information they provide is accurate, complete or true.

We make no recommendation or representations in relation to any Personal Crowdfunder, their campaigns or events, or their fundraisers’ initiatives.

PERSONAL CROWDFUNDER TERMS

These Personal Crowdfunder Terms set out the Personal Crowdfunder’s and GoodHub Platforms Limited’s obligations with respect to the Personal Crowdfunder’s use of GoodHub.com.

In addition to these Personal Crowdfunder terms, the Personal Crowdfunder and principal applicant agrees to other terms when using GoodHub.com.

REGISTERING WITH GOODHUB.COM

The Personal Crowdfunder must not register with GoodHub Platforms Limited more than once.

To register as a Personal Crowdfunder on GoodHub, you must:

  • Be at least 18 years old.
  • Be a resident of the United Kingdom.
  • Be legally capable of entering a binding contract.
  • Provide truthful, complete, and accurate information, including identity verification, contact information, and banking details.
  • Provide such information and assistance as GoodHub may reasonably require to verify your identity, contact details, bank account and eligibility to use the service, and to carry out fraud, security and financial crime checks.

GoodHub may use independent third-party verification providers and other appropriate data sources to verify information provided by you and to assess fraud, security and financial crime risk. Where verification cannot be completed, or where information or activity gives rise to concerns, GoodHub may request additional information or documents, carry out further checks, delay or prevent publication, suspend a Page, restrict fundraising or transfers, or reject an application.

PURPOSE AND USE OF FUNDS

All Personal Crowdfunder campaigns must:

  • Clearly state the reason for fundraising and the intended beneficiary.
  • Use all funds solely for the described purpose.
  • Be honest, transparent, and specific about how funds will be used.

You may raise funds for causes including (but not limited to):

  • Personal medical expenses.
  • Emergency hardship or crisis relief.
  • Educational costs or tuition fees.
  • Funeral and memorial costs.
  • Family or household support.

GoodHub will not accept applications to register from Personal Crowdfunders:

  • Where the intended use of the funds would be illegal, including where the provision and/or use of the funds would be in breach of applicable financial or other sanctions, including pyramid schemes or get-rich-quick schemes.
  • That promote or seek to fund/support any military organisation, terrorism, rebel groups, militias or gangs, or the purchase or procurement of weapons.
  • That incite, promote or enact violence, defamation, hatred or harassment of any individual or group for any reason, including race, ethnic origin, religion, gender, age, sexual orientation, gender identity or disability.
  • That pose an obvious and significant threat to individual or public safety, including but not limited to medical treatments by unlicensed practitioners or facilities, prescription drugs without a prescription, or the purchase or procurement or distribution of illegal drugs or adult content.
  • Causes that breach public trust, consumer protection standards, or UK advertising laws.
  • That are established primarily to support or oppose political parties, election candidates, referendums, lobbying activity, or legislative or regulatory change, including political campaigning, political advertising, or coordinated political advocacy campaigns. GoodHub may, at its sole discretion, permit limited non-partisan issue-based or community advocacy fundraising where it considers the campaign lawful, non-violent, and consistent with the purpose and reputation of the platform.

GoodHub Platforms Limited’s decision to accept or reject an application is final and there is no obligation on GoodHub Platforms Limited to share its reasons for its decision with the Personal Crowdfunder.

ACCESS TO GOODHUB.COM

The Personal Crowdfunder’s username and password provide access to the Personal Crowdfunder’s area of GoodHub.com.

PERSONAL CROWDFUNDER VERIFICATION

Personal Crowdfunders must provide sufficient information to enable GoodHub to carry out identity, contact, bank account, fraud and financial crime checks. This may include your full legal name, residential address, date of birth, mobile phone number, email address and bank account information.

GoodHub may use independent third-party verification providers and other appropriate data sources to validate this information and assess whether it is consistent with the information you have provided and with GoodHub’s fraud and financial crime requirements.

Successful completion of one verification check does not necessarily mean that all verification requirements have been satisfied. GoodHub may request additional information or documentary evidence where verification is incomplete, unsuccessful or where other risk indicators or concerns arise.

GoodHub reserves the right to reject an application, delay or prevent publication, pause or suspend a Page, prevent further donations, delay or withhold transfers or close an account where required verification has not been successfully completed or where GoodHub otherwise has reasonable compliance, fraud, security or financial crime concerns.

THE PERSONAL CROWDFUNDER’S FUNDRAISING PAGE (“PAGE(S)”)

The Personal Crowdfunder’s pages contain information submitted by the Personal Crowdfunder, including a video clip, where the Personal Crowdfunder has opted to submit such a clip.

By registering a Personal Crowdfunder and creating and publishing pages on GoodHub, the Personal Crowdfunder understands and agrees that information about the Personal Crowdfunder, its pages and associated content will be published for public distribution and inspection. The Personal Crowdfunder agrees that GoodHub can distribute the pages and content therein, including images and video, via its own communications, including, but not exclusive to, email, newsletter, media communications and social media communications.

By registering, the Personal Crowdfunder confirms to GoodHub Platforms Limited, users and fundraisers, that the information contained in the Personal Crowdfunder’s pages is complete, accurate and up to date.

CAMPAIGN CONTENT GUIDELINES (PERSONAL CROWDFUNDERS)

Personal Crowdfunders are responsible for ensuring that all content published on their page is clear, accurate, and focused on the purpose of their fundraising.

Campaign content must:

  • Clearly describe the purpose of the fundraising and intended use of funds
  • Be honest, transparent, and not misleading in any way
  • Be relevant to the Personal Crowdfunder’s story, needs, and activities

Campaign content must not:

  • Include references to GoodHub’s fees, voluntary contributions, or business model
  • Attempt to explain, influence, or reinterpret the donation process or platform mechanics
  • Contain any information that may cause confusion or inconsistency in how GoodHub’s services are presented to users
  • Contain graphic, violent, intimidating, or inflammatory imagery or content that GoodHub reasonably considers likely to cause distress, promote hostility, or create reputational, legal, regulatory, or payment processing risk for the platform.
  • Be false, fabricated, deceptive or materially misleading as to the circumstances of the Personal Crowdfunder, the beneficiary, the purpose of the campaign or the intended use of funds
  • Include images, documents or other material that the Personal Crowdfunder does not have the right to use, or that falsely or misleadingly represents the circumstances described in the campaign
  • Impersonate another person or misrepresent the identity of the Personal Crowdfunder or intended beneficiary

GoodHub may use automated systems and manual review to assess campaign content and imagery for compliance with these Terms and to identify potential fraud, deception, financial crime, safety, credibility or other trust concerns. Automated review may be used to identify Pages requiring further review but will not, solely on the basis of writing style or presentation, constitute a definitive finding that a campaign is fraudulent.

Where concerns arise, GoodHub may request additional information or evidence, delay or prevent publication, edit or remove content, temporarily pause or suspend a Page, restrict further donations or transfers, or take any other proportionate action permitted under these Terms.

FEES

Personal Crowdfunders typically receive 100% of the funds they raise on GoodHub.com.

There is no charge to register on GoodHub. If your request to register is accepted, then there is no subscription fee for creating and publishing a page on GoodHub.com

GoodHub does not charge a payment processing fee on Personal Crowdfunders.

GoodHub is a business and needs to generate revenue to provide its services. Donors are invited to add a voluntary contribution added by the user to their donation and/or ticket purchase and/or participation fee*. The voluntary contribution is paid directly to and retained by GoodHub.

GoodHub’s “fair fee” policy does NOT apply in respect of the voluntary contribution on Personal Crowdfunders.

VERIFICATION THRESHOLD AND TEMPORARY PAUSE

GoodHub may allow a Personal Crowdfunder Page to be published and begin accepting donations while certain verification checks are being completed.

If a Personal Crowdfunder reaches £500 or more in donations before both identity verification and bank account verification have been successfully completed, the Page will be temporarily paused.

While the Page is paused:

  • it will not be able to accept further donations;
  • funds already received will remain held pending completion of the required verification and any other applicable checks; and
  • the Personal Crowdfunder will be required to complete any outstanding identity and/or bank account verification requirements.

The Page will normally be reinstated once GoodHub is satisfied that both identity and bank account verification have been successfully completed, provided that no other compliance, fraud, security or risk review or restriction applies.

GoodHub may pause a Page or restrict donations or transfers before the £500 threshold is reached where it has reasonable compliance, fraud, financial crime, security or other risk concerns.

The £500 verification threshold operates in addition to the time limits and other requirements set out under Identity and Bank Account Verification and Page Closure below.

TRANSFER OF FUNDS

Funds raised on your Personal Crowdfunder will be transferred to the verified bank account you provide according to the following schedule:

  • Transfers are made on Thursdays each week.

  • Each Thursday transfer includes funds received between Monday and Sunday of the previous week.

  • The first transfer from your Personal Crowdfunder will be made no earlier than 14 days after the date your first donation is received. This delay allows for necessary fraud and verification checks.

GoodHub reserves the right to delay, suspend or refuse transfers where verification remains incomplete or unsatisfactory, where GoodHub is conducting a compliance or fraud review, where fraud, financial crime, unauthorised payments or a breach or suspected breach of these Terms is identified or reasonably suspected, or where GoodHub otherwise has a legitimate legal, security, compliance or risk reason for doing so.

CHARGEBACKS AND REFUNDS

In the event that a donation is reversed due to a chargeback, refund request, or any other reason after funds have been disbursed to you, you agree to reimburse GoodHub the full amount of the reversed transaction. GoodHub will notify you of any such occurrences and provide details of the transaction in question. Failure to reimburse GoodHub may result in suspension or termination of your account and potential legal action to recover the funds.

IDENTITY AND BANK ACCOUNT VERIFICATION AND PAGE CLOSURE

These requirements apply in addition to the Verification Threshold and Temporary Pause provisions above.

Irrespective of the amount raised, you must successfully complete both identity verification and bank account verification within 30 days of your Personal Crowdfunder being published.

If either identity verification or bank account verification has not been successfully completed within 30 days, your Personal Crowdfunder Page will be temporarily paused and will no longer be able to accept donations.

If both identity verification and bank account verification are subsequently successfully completed within 60 days of your Personal Crowdfunder being published, your Page will normally be reinstated, provided that no other compliance, fraud, security or risk review or restriction applies.

If both identity verification and bank account verification have not been successfully completed within 60 days of your Personal Crowdfunder being published, your Page will be permanently closed and cannot be reopened.

Following permanent closure of your Page, you may still submit information or documentation required to complete identity and bank account verification for the purpose of enabling GoodHub to transfer any funds already raised. Permanent closure of your Page does not prevent GoodHub from completing outstanding verification or, where verification is successfully completed and no other restriction applies, transferring funds already raised in accordance with these Terms and Conditions.

If the required verification has not been successfully completed within 12 months of your Personal Crowdfunder being published and GoodHub is therefore unable to transfer funds raised on your behalf, those funds may be handled in accordance with the Re-appropriation of Donations provisions below.

RE-APPROPRIATION OF DONATIONS

If we are unable to transfer the funds donated to or raised on behalf of your Personal Crowdfunder via GoodHub for any reason whatsoever, then GoodHub may re-appropriate the relevant funds at its discretion. Circumstances include but are not limited to:

  • Where a Personal Crowdfunder has not successfully completed the identity and bank account verification required by GoodHub within 12 months of their Personal Crowdfunder being published, and GoodHub is therefore unable to transfer the funds raised on their behalf.

  • In its exclusive opinion, GoodHub has been unable to satisfactorily verify that the recipient bank account belongs to the client Personal Crowdfunder.

For the purposes of this section, the right to “re-appropriate funds” shall mean the right for GoodHub to use or apply the relevant monies as GoodHub determines at its sole discretion including, without limitation, making donations to other charities or non-profits, enhancing other donations, or for its internal business purposes (including retaining the funds).

THE PERSONAL CROWDFUNDER’S LIABILITY TO GOODHUB PLATFORMS LIMITED

The Personal Crowdfunder is liable to GoodHub Platforms Limited for any loss or damage suffered by GoodHub Platforms Limited or any user of GoodHub as a result of the Personal Crowdfunder (or a person using the Personal Crowdfunder’s username and password with the Personal Crowdfunder’s knowledge or permission or through the Personal Crowdfunder’s negligence):

  1. Using GoodHub.com in a way that is fraudulent.
  2. Breaching these Personal Crowdfunder Terms.
  3. Otherwise using GoodHub.com in a way that causes loss or damage to GoodHub Platforms Limited or any other user of GoodHub.com.
  4. Receiving funds from donations that are later subject to chargebacks or refunds, and failing to reimburse GoodHub Platforms Limited for such amounts upon request.

GOODHUB PLATFORMS LIMITED’S LIABILITY TO THE PERSONAL CROWDFUNDER

GoodHub Platforms Limited is not liable to the Personal Crowdfunder for any loss, damage or cost arising out of or in connection with the Personal Crowdfunder’s registration with GoodHub Platforms Limited or use of GoodHub.com, except where the loss, damage or cost is a result of GoodHub Platforms Limited’s breach of these Personal Crowdfunder terms, negligence or fraud.
GoodHub Platforms Limited’s liability to the Personal Crowdfunder will not exceed 10,000 pounds in respect of all claims.

Nothing in these Personal Crowdfunder Terms excludes or limits GoodHub Platforms Limited’s liability for death or personal injury caused by its negligence or for fraud.

ASSIGNMENT

GoodHub Platforms Limited may transfer or delegate any of its rights or obligations under these Personal Crowdfunder Terms to any person. GoodHub Platforms Limited may provide information about the Personal Crowdfunder and the Personal Crowdfunder activities on GoodHub.com to that person.

The Personal Crowdfunder may not transfer any of its rights or obligations under these Personal Crowdfunder Terms.

AMENDMENTS

GoodHub Platforms Limited may amend these Personal Crowdfunder Terms from time to time and need not give the Personal Crowdfunder notice of the amendments.

These terms will display the date that any amendments were effective.

NOTICES

All notices given under these Personal Crowdfunder Terms or any other terms relating to GoodHub.com must be in writing and in English.

GoodHub Platforms Limited may deliver a notice to the Personal Crowdfunder by placing a message on the Personal Crowdfunder’s area of GoodHub.com or by email or post to the contact details last known to GoodHub Platforms Limited.

A notice from GoodHub Platforms Limited will be effective at the time of placing a message on GoodHub.com or sending an email, or on the second business day after posting. A business day is a weekday other than a national holiday.

A notice from the Personal Crowdfunder to GoodHub Platforms Limited can be sent by email to admin@GoodHub.com, or by post to GoodHub Platforms Limited Customer Service, 7 Gay Street, Bath, BA1 2PH. Notices to GoodHub Platforms Limited will be effective on receipt.

COMPLAINTS

Complaints must be made in writing to GoodHub.com Customer Services, 7 Gay Street, Bath, BA1 2PH. Notices to GoodHub Platforms Limited will be effective on receipt.

NO WAIVER

If GoodHub Platforms Limited does not enforce any of its rights under these Personal Crowdfunder Terms or any other terms relating to GoodHub.com, it does not mean that GoodHub Platforms Limited will be unable to enforce that right in future.

THIRD PARTY RIGHTS

A person who is not a party to these Personal Crowdfunder Terms may not enforce any of these terms.

LAW AND JURISDICTION

These Personal Crowdfunder Terms and any non-contractual obligations arising out of or in connection with it are governed by English Law and the English courts have exclusive jurisdiction.
For the benefit of GoodHub Platforms Limited, the Personal Crowdfunder irrevocably submits to the jurisdiction of the English courts and irrevocably agrees that a ruling in those courts will be conclusive and binding on the Personal Crowdfunder and may be enforced against the Personal Crowdfunder in the courts of any other jurisdiction.

PERSONAL INFORMATION

In order to provide the GoodHub service, GoodHub collects and processes personal information relating to Personal Crowdfunders. This may include, but is not limited to, the Personal Crowdfunder’s name, title, residential address, date of birth, email address, mobile telephone number, bank account information and other information provided by the Personal Crowdfunder or obtained in connection with verification, fraud prevention, security and compliance checks.

GoodHub may use personal information to verify the identity, contact details, bank account and eligibility of a Personal Crowdfunder, to administer Personal Crowdfunder Pages and payments, and to prevent, detect and investigate fraud, financial crime, misuse of the GoodHub service and breaches or suspected breaches of these Terms and Conditions.

For these purposes, GoodHub may use independent third-party verification, payment and other service providers and may check information provided by Personal Crowdfunders against appropriate third-party data sources. GoodHub may also receive information and risk indicators from such providers as part of its verification, fraud prevention, security and compliance processes.

Where required or appropriate, GoodHub may disclose personal information to its payment processors, acquiring or banking partners, identity and verification providers, professional advisers, regulators, law enforcement agencies or other competent authorities, subject to applicable law.

Personal information will be collected, used, stored and otherwise processed in accordance with GoodHub’s Privacy Policy and applicable data protection law. Further information about how GoodHub processes personal information, including the purposes for which it is used, the parties with whom it may be shared and the rights of individuals in relation to their personal information, is set out in GoodHub’s Privacy Policy.

INTERMEDIARIES

GoodHub acts as an intermediary between Personal Crowdfunders and users of the website. Personal Crowdfunders are responsible for the information, content and materials they submit to GoodHub and for ensuring that such information, content and materials are accurate, lawful and not false, deceptive or misleading.

GoodHub does not create or independently verify all information submitted by Personal Crowdfunders and does not guarantee the accuracy, completeness or reliability of information appearing on a Personal Crowdfunder Page.

GoodHub may use automated systems and manual review to moderate and assess information, content and imagery submitted by Personal Crowdfunders for compliance with these Terms and Conditions and to identify potential fraud, deception, financial crime, safety, credibility or other trust concerns.

Where concerns arise, GoodHub may request additional information or evidence, delay or prevent publication, edit or remove content, temporarily pause or suspend a Page, restrict further donations or transfers, close a Page or account, or take any other proportionate action permitted under these Terms and Conditions.

The use of automated systems or manual review does not mean that GoodHub has verified, endorsed or approved the accuracy or authenticity of any Personal Crowdfunder Page, nor does publication of a Page constitute any representation or warranty by GoodHub as to the Personal Crowdfunder, the circumstances described, the intended use of funds or the accuracy of information provided.

LICENCE OF TRADEMARK AND COPYRIGHTED MATERIAL

You hereby grant to GoodHub Platforms Limited, its affiliates and its partners a non-exclusive licence to use any of your GoodHub pages’ trademarks and any copyrighted material or other content including written, images and videos (or any link to the same) solely in connection with the website and associated services and its operation and promotion and for no other purpose whatsoever.

You solely are responsible for ensuring that you have gained the appropriate permission of any of and all the individuals and premises, venues and similar captured in images or videos (or any link to the same) that you submit to GoodHub for your pages. If you do not have permission, then you should immediately remove that published content from GoodHub.

The licence shall terminate automatically on expiry or termination of these Terms of Service or the removal of your GoodHub pages from the website in accordance with these Terms and Conditions.

DISCLAIMER AND LIMITATION OF LIABILITY

Notwithstanding the provisions of the Disclaimer and Limitation of Liability section of the core Terms and Conditions, GoodHub Platforms Limited’s total liability to you arising under or in connection with these Terms and Conditions, so far as such liability arises out of or relates to your creation and/or use of an GoodHub pages, shall be limited to the total fees paid by you to GoodHub Platforms Limited under these Terms and Conditions for your use of the website and associated services during the preceding 12 month period ending on the date the circumstances giving rise to the liability arose.

CONFIDENTIAL INFORMATION

During the published period of your GoodHub pages and for a period of seven (7) years thereafter, the parties shall treat as strictly confidential all information about the other which has been acquired as a result of the use of the website and associated services and which is not in the public domain.

No party shall use or disclose to any third party such information belonging to the other party without that party’s prior written consent, except where required to do so by applicable law, including, without limitation, the Freedom of Information Act 2000 and the Environmental Information Regulations 2004, or regulatory or governmental body. This paragraph shall survive termination of these Terms and Conditions.

TERMINATION

GoodHub Platforms Limited reserves the right, at its sole discretion, to immediately and without notice suspend or permanently deny your access to all or part of the website and associated services, including for example by removing any GoodHub pages from the website. GoodHub Platforms Limited will only exercise this right where there is a breach or suspected breach by you of these Terms and Conditions (including where there is any actual or suspected fraudulent, criminal or improper use of the website or associated services) or where GoodHub Platforms Limited has any other legitimate reason to do so.

These Terms and Conditions shall terminate automatically upon the removal by you or GoodHub Platforms Limited of your GoodHub pages from the website. These Terms and Conditions will continue to apply to past use by you.

Upon termination or suspension or denial of access to the website and associated services, funds already received on your behalf by GoodHub Platforms Limited will be handled in accordance with the provisions above, provided that any potential payment (where applicable) may be delayed where GoodHub Platforms Limited conducts an investigation regarding your use of the website and associated services and GoodHub Platforms Limited may decide to refuse to pay funds across to you where you have breached these Terms and Conditions or your GoodHub pages have been removed. In such circumstances GoodHub Platforms Limited may authorise a refund of donations to donors.

GoodHub Platforms Limited may decide to refuse to pay funds across to you where you have breached these Terms and Conditions, your GoodHub pages have been removed, or where donations are subject to chargebacks or refunds. In such circumstances, GoodHub Platforms Limited may authorise a refund of donations to donors and seek reimbursement from you for any funds already disbursed.
